§ H. Administrative variances.

  • The community development director shall have the power to grant variances (except for density and use variances) from the dimensional standards of the ordinance where, in his opinion, the intent of the ordinance can be achieved and equal performance obtained by granting a variance. The authority to grant such variances shall be limited to variances from the following requirements:

    (1)

    Front yard or yard adjacent to public street - Variance not to exceed five feet.

    (2)

    Side yard - Variance not to exceed three feet.

    (3)

    Rear yard - Variance not to exceed five feet.

    (4)

    Height - Variance not to equal or exceed ten feet, provided that no variance may result in an increase in the number of stories than would otherwise be allowed under the applicable zoning district.

    (5)

    A reduction of the minimum number of required parking spaces up to a maximum of ten percent.

    (6)

    A reduction of the minimum distance to any property line for animal quarters (agricultural facilities, kennels, etc.) up to a maximum of 50 feet.

    The director shall not have the authority to grant any additional administrative variances after a variance has been approved by the zoning board of appeals.
