§ B. Initiation of amendments.

  • (1)

    Applications to amend this ordinance may be in the form of proposals to amend the text or the official zoning maps.

    (a)

    An application to amend the text of this ordinance may be initiated by the planning commission or be submitted to the planning commission by the board of commissioners or by any person having an interest in the county.

    (b)

    An application to amend the official zoning map may be initiated by the planning commission, or may be submitted to the planning commission by the board of commissioners, or may be submitted by any person having an interest in the county.

    (2)

    Unless initiated by the board of commissioners or the planning commission, all applications (rezoning, land use, special use, or medical hardships) must be submitted by the owner of the affected property or the authorized agent of the owner. If submitted by an agent of the owner, such authorization shall be notarized and attached to the application.

    An application may be withdrawn without prejudice at any time prior to the date scheduled for the hearing by the planning commission. Unless withdrawn at the hearing, the withdrawal must be in writing, signed and dated by the applicant. If an application is withdrawn by the applicant after the legal advertising as required by this article shall have first appeared, the cost of the advertising and any other expenses incurred may be deducted from any refund of fees.

    The applicant, or his/her representative, must be present at the hearing or the application may not be heard.
