§ A. Definitions.

  • The following words, terms and phrases, when used in this ordinance, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Building official means the duly appointed building inspector for the county or such inspector's authorized representative.

    Component means any assembly, subassembly, or combination of parts for use as a part of a building, which may include structural, electrical, plumbing, mechanical, and fire protection systems and other systems affecting health and safety.

    Health officer means the legally designated health authority of the county or such authority's authorized agent.

    Industrialized building means any structure or component thereof which is wholly or in substantial part made, fabricated, formed, or assembled in manufacturing facilities for installation or assembly and installation on a building site; which has been manufactured in such a manner that all parts or processes cannot be inspected at the installation site without disassembly, damage, or destruction thereof; and which bears an insignia of the state department of community affairs indicating state approval pursuant to the acts of the General Assembly.

    Installation means the assembly of an industrialized building onsite and the process of affixing the industrialized building, component, or system to land, a foundation, footings, or an existing building.

    Manufacture means the process of making, fabricating, constructing, forming, or assembling a product from raw, unfinished, or semi-finished materials.

    Manufactured home means a structure, transportable in one or more sections, which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air-conditioning, and electrical systems contained therein; such term shall include any structure which meets all the requirements of this paragraph and with respect to which the manufacturer voluntarily files a certification required by the secretary of housing and urban development and complies with the standards established under the National Manufactured Housing Construction and Safety Standards Act of 1974, 42 USC 5401 et seq.

    Manufactured home, class I means a manufactured home intended for use as a single-family dwelling unit that bears an insignia indicating compliance with the requirements of the U.S. Department of Housing and Urban Development (HUD), or one, if constructed prior to applicability of such insignia requirements, was constructed in conformity with the state standards in effect on the date of manufacture, and has a width of 16 feet or less.

    Manufactured home, class II means a manufactured home intended for use as a single-family dwelling unit that meets the requirements of a manufactured home, class I, and has a minimum width in excess of 16 feet.

    Manufactured home park means a lot or parcel of land which has been planned and improved for the placement of manufactured homes and/or mobile homes for nontransient use.

    Manufactured home space means a plot of ground within a manufactured home park designated for the accommodation of not more than one manufactured home of single-family occupancy.

    Mobile home means a structure, transportable in one or more sections, which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air-conditioning, and electrical systems contained therein and manufactured prior to June 15, 1976.

    Modular home means a factory-manufactured single-family dwelling which is constructed in one or more sections and complies with the definition of "industrialized building."

    Service buildings means a building housing facilities, such as: recreational, maintenance, laundry, and office structures necessary to the successful development and management of a manufactured home park.

    Single-family dwelling unit means a structure designed, arranged, and used for occupancy by one or more persons living as a single housekeeping unit or family.

    Site means the entire tract, subdivision, or parcel of land on which the industrialized building, manufactured home, or mobile home is installed.

    System means structural, plumbing, mechanical, electrical, or fire safety elements, materials, or components used separately or combined for use in a building.

    Travel trailer means a mobile unit designed for camping, recreational travel or vacation use which is equipped with a chassis and provides partial housekeeping facilities.
