§ 18-33. Scope.

  • (a)

    General. Where in any specific case, different sections of these technical codes specify different materials, methods of construction or other requirements, the most restrictive shall govern. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable. A brief description of the general applicability of each code is presented as follows:

    (1)

    Building. The provisions of the International Building Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the construction, alteration, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures, except in the following:

    i.

    One- and two-family dwellings

    ii.

    Agricultural structures not housing animals or people in A-1 zoning districts that meet all of the following conditions:

    a.

    No utilities shall be installed

    b.

    Footprint equal to or less than 1,500 square feet

    c.

    Open from ground to eaves on all sides

    d.

    Only used for storage of farm implements/goods

    e.

    May not be used or converted for any other purposes without obtaining building permit

    f.

    Comply with all applicable state and local building codes and zoning ordinances

    (2)

    Gas. The provisions of the International Fuel Gas Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the installation of consumer's gas piping, gas appliances and related accessories as covered in this Code. These requirements apply to gas piping systems extending from the point of delivery to the inlet connections of appliances and the installation and operation of residential and commercial gas appliances and related accessories, except in one- and two-family dwellings.

    (3)

    Mechanical. The provisions of the International Mechanical Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the installation of mechanical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and/or appurtenances, including ventilating, heating, cooling, air conditioning and refrigeration systems, incinerators, and other energy-related systems, except in one- and two-family dwellings.

    (4)

    Plumbing. The provisions of the International Plumbing Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to every plumbing installation, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances, and when connected to a water or sewerage system.

    (5)

    Electrical. The provisions of the National Electrical Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment appliances, fixtures, fittings and appurtenances thereto.

    (6)

    Fire prevention. The provisions of the International Fire Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the construction, alteration, repair, equipment, use and occupancy, location and maintenance of every building or structure or any appurtenances connected or attached to such buildings or structures.

    (7)

    Energy. The provisions of the International Energy Code, as adopted and amended by the Georgia Department of Community Affairs, shall regulate the design of building envelopes for adequate thermal resistance and low air leakage and the design and selection of mechanical, electrical service, water heating and illumination systems and equipment that will enable the effective use of energy in new building construction.

    (8)

    One- and two-family dwelling. The provisions of the International Residential Code, as adopted and amended by the Georgia Department of Community Affairs, shall apply to the construction, alteration, repair, equipment, use and occupancy, location and maintenance of every one- or two-family dwelling or any appurtenances connected or attached to such buildings or structures.

    (9)

    Unsafe buildings and systems. The provisions of the International Property Maintenance Code, as adopted and amended by the Georgia Department of Community Affairs, provides code enforcement personnel with the necessary tools to have dangerous and unsafe buildings and systems repaired, demolished.

    (b)

    Federal and state authority. The provisions of these technical codes shall not be held to deprive any federal or state agency, or any applicable governing authority having jurisdiction, of any power or authority which it had on the effective date of the adoption of these technical codes or of any remedy then existing for the enforcement of its orders, nor shall it deprive any individual or corporation of its legal rights as provided by law.

    (c)

    Appendices. Appendices referenced in the code text of the technical codes shall be considered an integral part of the technical codes.

    (d)

    Referenced standards. Standards referenced in the text of the technical codes shall be considered an integral part of the codes. If specific portions of a standard are denoted by code test, only those portions of the standard shall be enforced. Where code provisions conflict with a standard, the code provisions shall be enforced. Permissive and advisory provisions in a standard shall not be construed as mandatory.

    (e)

    Safety and maintenance of structures. All buildings, structures, electrical, gas, mechanical and plumbing systems, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguard which are required by the technical codes when constructed, altered, or repaired, shall be maintained in good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings, structures, electrical, gas, mechanical and plumbing systems.
