§ 40-1. Definitions.

  • As used in this chapter, the following terms shall have the respective meanings ascribed to them:

    Garbage means any spoiled or waste food, whether the same be for animal or human consumption, which results from either the handling, preparation, cooking, consumption or disposal of such food.

    Handbill means any printed, typed, or written material whether the same be on paper, poster board, cardboard, or any other surface which is capable of distribution or circulation including any circular, leaflet, pamphlet, newspaper, magazine, booklet or other printed or reproduced matter whether the same is for commercial, noncommercial, civic, religious, or political purposes.

    Junk vehicle means any vehicle, automobile, truck, van, trailer of any kind or type, or contrivance or part thereof, which is wrecked, dismantled, partially dismantled, stripped, partially stripped, inoperative, abandoned, discarded, is not able to be legally operated on a public roadway, inclusive of not having a current, legally valid license plate. This definition shall not apply to agricultural equipment which is designed exclusively for agrarian purposes and which are not normally operated on a public roadway, such as tractors, combines, harvesters and similar agricultural equipment, and are in use or stored upon property which is zoned as "agricultural".

    Litter means garbage, trash, refuse, rubbish, sand, gravel, slag, brickbats, waste material, tin cans, trash, debris, dead animals, dead trees, weeds, junk vehicles or parts from junk vehicles, or discarded items or materials of any kind of description which have been set in a disorderly state which would tend to create a danger to the public health, safety, and welfare of the citizens of this county.

    Person means any person, firm, association, corporation, company, or other entity whether legally constituted or simply associated in fact.

    Private property means any dwelling, structure, building, land, lake, stream, body of water or course of water, farm, or any other piece of real or personal property whether used for agricultural, residential, commercial, industrial, or religious purposes which is owned by, leased by, or under the control of a private person.

    Public property means any and all public property which is owned by, leased by or controlled by any governmental or quasi-governmental agency, or authority including but not limited to public street, roads, rights-of-way, sidewalks, playgrounds parks, and buildings or items of real and personal property which are located thereon and which are under the control of a governmental entity, agency, or authority.

    Refuse means anything that is thrown away or rejected as worthless or useless such as trash, rubbish, garbage, and includes any solid waste and any property held for salvage purposes.

    Rubbish means any solid waste which is not susceptible to becoming putrid and consists of such things as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials which are rejected or thrown away as worthless.
