§ 62-61. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    County road means a highway, road, street, avenue, toll road, tollway, drive, detour, or other way open to the public and intended or used for its enjoyment and for the passage of vehicles in the county, including, but not limited to, the following public rights, structures, sidewalks, facilities, and appurtenances incidental to the construction, maintenance, and enjoyment of such rights-of-way:

    (1)

    Surface, shoulders, and sides;

    (2)

    Bridges;

    (3)

    Causeways;

    (4)

    Viaducts;

    (5)

    Ferries;

    (6)

    Overpasses;

    (7)

    Underpasses;

    (8)

    Railroad grade crossings;

    (9)

    Tunnels;

    (10)

    Signs, signals, markings, or other traffic control devices;

    (11)

    Buildings for public equipment and personnel used for or engaged in administration, construction, or maintenance of such ways or research pertaining thereto;

    (12)

    Wayside parks;

    (13)

    Parking facilities;

    (14)

    Drainage ditches;

    (15)

    Canals and culverts;

    (16)

    Rest areas;

    (17)

    Truck-weighing stations or check points;

    (18)

    Scenic easements and easements of light, air, view, and access;

    (19)

    County-owned or maintained right-of-way, defined as property or any interest therein, whether or not in the form of a strip, which is acquired for or devoted to a public road; and

    (20)

    Any other such property not otherwise defined in this article which is maintained by the county in connection with passage of vehicles for public purposes.

    Heavily laden vehicle means any vehicle bearing, while loaded or unloaded, more total weight or axle weight than that permitted by state law as codified at O.C.G.A. § 32-6-26.

    Major temporary work site means any tract or parcel of land measuring 75 acres or more, from which either wood products are harvested or other operations are occurring which constitute land disturbing activity under article 9 of appendix B of this Code.

    Minor temporary work site means any tract or parcel of land measuring less than 75 acres, from which either wood products are harvested or other operations are occurring which constitute land-disturbing activity under article 9 of appendix B of this Code.

    Truck route means any road or portion thereof, within the unincorporated county limits, over which trucks are not prohibited to operate by the provisions of section 62-7.

    Any terms not specifically defined in this section shall have the same definition, if any, provided under O.C.G.A. §§ 32-1-3 and 32-6-26.
