§ 67-18. Violations; penalties.

  • (a)

    Noncompliance. No person shall erect on any premise owned or controlled by that person any sign which does not comply with the standards or requirements of this chapter.

    (b)

    Dangerous or defective. No person shall maintain or permit to be maintained on any premises owned or controlled by that person any sign which is in a dangerous or defective condition. Any such sign shall be removed or repaired by the applicant of the sign, the owner of the premises, or as otherwise provided for in this chapter.

    (c)

    Separate violation. Each sign installed, created, erected, or maintained in violation of this chapter shall be considered a separate violation when applying the penalty portions herein. Additionally, for each such sign, a separate violation shall be deemed to exist for each day the sign is in violation of this chapter.

    (d)

    Public nuisance. Any violation of this chapter is hereby declared to be a public nuisance.

    (e)

    Notice. The director or Paulding County Marshal's Office shall give the violator ten days' written notice, based on the practical considerations of completing measures to comport with the standards of this chapter, to correct the deficiencies or to remove the sign(s) which is in violation of this chapter. If the violator refuses to correct the deficiencies or remove the sign, the director or marshal's office may have the sign removed at the expense of the violator.

    (f)

    Citations. If any sign or other device covered by this chapter is erected, constructed, altered, converted or used in violation of any provision of this chapter, the Paulding County Marshal's Office may issue a citation. Additionally, the county may seek an injunction for a continuing violation or take other appropriate action to prevent such unlawful erection, construction, alteration, conversion, or use to correct or abate such violation. Any violation of this chapter shall be a misdemeanor offense, and the violator shall be subject to a fine of up to $1,000.00, imprisonment for up to 60 days, or by both such fine and imprisonment.
